Welcome to Ashley Ellis Photos, LLC (“Company,” “we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our website (ashleyellisphotos.com) and all services we provide, including photography coverage, communications, online galleries, and related deliverables. By using our website or hiring us for services, you agree to these Terms.
1. Services Provided
Ashley Ellis Photos, LLC offers professional photography services. All services require a signed contract and non-refundable retainer to reserve a date. Services may include weddings, engagements, portraits, and other commissioned photography sessions.
Session availability, locations, turnaround times, and pricing are subject to change.
2. Payment & Booking
A non-refundable retainer is required to secure your date. The remaining balance must be paid before the session or by the deadline stated in your signed contract. Failure to pay may result in cancellation without refund of the retainer.
We do not offer refunds for retainers, delivered images, or digital products.
3. Rescheduling & Cancellations
If the client needs to reschedule due to weather, illness, or emergencies, we allow one complimentary reschedule. Additional rescheduling fees may apply.
If a cancellation occurs before the final payment is made, all retainers and fees previously paid remain non-refundable.
If the photographer must cancel due to emergency or inability to perform, client will receive a full refund of any payments made, excluding delivered work.
4. Image Delivery & Turnaround
Images are delivered through a private online gallery (PASS). Gallery links remain active for up to five years. Delivery timelines vary by session type and are listed in your signed contract.
Raw (unedited) files are never provided, sold, or released to clients under any circumstances.
5. Copyright & Image Use
All photographs remain the exclusive intellectual property of Ashley Ellis Photos, LLC under U.S. Copyright Law. Clients receive a personal-use license only, unless otherwise stated in writing.
Clients may:
✔ Download images
✔ Print for personal use
✔ Share online with credit (tagging encouraged)
Clients may not:
✘ Sell or sublicense images
✘ Edit, filter, or alter photos in any way
✘ Use images for commercial or promotional use without written permission
6. Model Release (Image Sharing)
We reserve the right to use photographs for business promotion, advertising, website display, portfolio, and social media unless the client opts out in writing prior to the session or within 7 days after gallery delivery.

7. Liability
Ashley Ellis Photos, LLC is not responsible for circumstances beyond our control, including weather, venue rules, accidents, natural events, or equipment failure. We take every measure to avoid loss or damage to images. In the unlikely event of lost files, damaged media, or full failure to deliver finished work, liability is limited to a refund of all fees paid.
8. Website Use
All content on ashleyellisphotos.com is protected by copyright. You may not copy, reuse, screenshot, or distribute any content (images, written content, logos) without written permission.
9. Changes to Terms
We may update these Terms at any time. Continued use of our website or services constitutes agreement to any updated Terms.
